Terms and Conditions
Version 0.2 for review | Last updated September 24, 2026 | Effective date [DATE]
These Terms govern your personal use of GatherThat, a subscription application for organizing collections and interacting with other collectors. They explain our service, payment arrangements, your responsibilities, and your rights if something goes wronlg. By selecting the Terms acknowledgement during registration, you agree to these Terms.
1 Who provides the service
GatherThat is operated by [FULL LEGAL ENTITY NAME], registered at 9660 Arborhill Drive, Dallas, TX 75243, United States, with registration number [IF APPLICABLE] and tax identification number [IF APPLICABLE] (“GatherThat,” “we,” “us”). Contact us at support@gatherthat.com or 9660 Arborhill Drive, Dallas, TX 75243, United States. Our privacy contact is [PRIVACY EMAIL].
These Terms include the Community Rules at /community-rules and the plan details presented before purchase. The Privacy Notice at [PRIVACY NOTICE URL] and Cookie Policy at [COOKIE POLICY URL] explain how we use personal information and cookies; accepting these Terms is not consent to optional marketing or all personal-data processing. Mandatory consumer protections take priority over conflicting terms. Specific Community Rules govern community conduct; these Terms govern payment and consumer rights.
2 Eligibility and your account
You must be at least 18 and legally able to enter this agreement. Give accurate registration and billing information, keep it current, protect your credentials, and notify us promptly of suspected unauthorized access. You may use a display name that protects your privacy, but must not impersonate another person or misrepresent your identity to us.
You are responsible for activity you authorize and for taking reasonable precautions to secure your account. You are not automatically responsible for activity caused by our security failures or unauthorized activity for which applicable law protects you. Accounts are personal and may not be sold or transferred without our written agreement. Do not share passwords or give another person secured access through your account. After termination for a violation, you may not register or use a replacement account without our written permission.
3 The service and your plan
Your plan describes included features, limits, price, billing interval, and any trial. Features may include collection management, sharing, messaging, groups, and tools that help describe or estimate the value of items. Availability depends on the plan and supported devices described before purchase. Internet access and a compatible device are required; your connection charges remain your responsibility.
Estimates, automated suggestions, market information, and AI-generated material can be inaccurate. They are not authentication, an insurance appraisal, or financial, legal, or tax advice. Verify information before relying on it. This does not reduce our responsibility to supply the service as described or any statutory remedies.
4 Subscriptions and payments
Before purchase, we disclose the total price, applicable taxes, billing frequency, trial duration, renewal terms, and how to cancel. A paid subscription renews for the disclosed interval until canceled, only after you expressly authorize recurring charges. Any trial conversion and its price must be disclosed and accepted before billing. We send an order confirmation and a copy of the applicable terms in a form you can retain.
You authorize the disclosed charges to your selected payment method. We will give legally required renewal and trial reminders. If payment fails, we may restrict paid features after notifying you and allowing a reasonable opportunity to resolve the failure; we will not add undisclosed penalties.
For purchases billed by an app store, that store administers payment, cancellation, and its refund process. We explain the applicable route before purchase. Store terms do not remove mandatory rights against the party legally responsible for supplying the service.
5 Cancellation and refunds
You may stop renewal at any time using the subscription controls in your account. For store-billed purchases, use the store’s subscription settings linked from your account. Contact support@gatherthat.com if you cannot access cancellation. We confirm cancellation and the date paid access ends. Cancellation must not require purchasing another service or completing a sales call.
Ordinary cancellation takes effect at the end of the current paid period. We do not ordinarily refund unused time, except where required by law, expressly promised at purchase, or provided under these Terms. Cancellation of renewal and deletion of your data are separate requests.
If we discontinue your paid service or terminate it for reasons unrelated to your breach, we refund prepaid charges for the unused period. Refunds due under mandatory withdrawal or defective-service rights are handled within the applicable statutory period, using the original payment method unless you agree otherwise without extra cost.
6 Withdrawal and additional consumer rights in Europe
We offer all consumers 14 days from concluding a service contract to withdraw without giving a reason. For EU consumers, this also reflects the ordinary statutory withdrawal period for a distance service contract; any greater mandatory protection applies. Send an unequivocal withdrawal statement to support@gatherthat.com or 9660 Arborhill Drive, Dallas, TX 75243, United States, or use the online withdrawal function. Sending it before the deadline is sufficient. You may use the form below, but do not have to. We acknowledge an online withdrawal without delay by email or another form you can retain. Missing legally required information may extend the statutory withdrawal period.
If you expressly request service to begin during that period and then withdraw, we may charge only the proportionate amount permitted by law for service supplied. Starting an ongoing subscription does not by itself eliminate withdrawal rights. Different rules can apply to separately supplied digital content; any required express consent and acknowledgement must be obtained separately before supply. We reimburse sums due within 14 days of receiving your withdrawal notice.
Withdrawal form: To [FULL LEGAL ENTITY NAME], 9660 Arborhill Drive, Dallas, TX 75243, United States, support@gatherthat.com. I give notice that I withdraw from my contract for [SERVICE], ordered on [DATE]. Consumer name [NAME]. Consumer address [ADDRESS]. Date [DATE]. Signature [ONLY IF SENT ON PAPER].
You retain statutory rights where digital services are not supplied or do not conform to the contract, including correction, price reduction, or termination and reimbursement when legally available. We supply required updates, including security updates. Similar mandatory protections in other countries remain available. The no-refund provisions do not override these rights.
7 Your content and our permission to use it
You retain your rights in the content you upload, such as collection records, photographs, descriptions, and messages. You must have the rights needed to upload and share it. You grant us a nonexclusive, worldwide, royalty-free license to host, copy, format, transmit, and display that content only as needed to operate, secure, and provide the service according to your sharing choices. Service providers may exercise these permissions for those purposes on our behalf.
This license does not transfer ownership or authorize unrelated advertising use of your private content. It ends when content is deleted from our systems, subject to limited backup retention, legal preservation, and copies lawfully retained by other users. Shared messages or contributions may remain with their recipients or in a shared discussion where lawful; we will address applicable deletion rights. Sharing publicly may allow others to copy your content, and we cannot retrieve every independently retained copy.
8 Acceptable use and community conduct
You must follow the Community Rules. Do not threaten, harass, discriminate against, exploit, defraud, or expose private information about others. Do not upload illegal material, infringe intellectual property, spread malware, bypass access controls, disrupt the service, scrape private information, harvest member data for unsolicited direct marketing, collect service data systematically through unauthorized automation, or evade restrictions through another account. Authorized integrations and your permitted use of export tools remain allowed. Authorized security research and rights that cannot lawfully be restricted remain protected.
We own or license the application, branding, and other service materials apart from user content. We grant you a limited right to use them through the service for your permitted personal use. No ownership transfers to you. Do not copy, redistribute, resell, or reverse engineer our software or proprietary service materials beyond the permissions these Terms or the service expressly give you. This does not restrict your own content, authorized exports and sharing, licensed third-party material, or activities permitted by mandatory law, including applicable quotation and interoperability rights.
9 Interactions and third parties
Members are responsible for their own statements and agreements. Unless a particular transaction expressly says otherwise, GatherThat is not the buyer or seller of a member’s collectible and does not guarantee authenticity, ownership, condition, payment, delivery, or another member’s conduct. Any transaction-specific terms must be presented before that transaction. These provisions do not exclude legal duties we have as a platform or service provider.
A link to a third-party website does not by itself mean we endorse its content, opinions, or products. Review its terms and privacy practices before providing information. Linked services may have their own terms and privacy notices. We identify material dependencies where relevant and remain responsible for obligations that the law places on us.
10 Suspension and termination for violations
GatherThat applies zero tolerance to confirmed Community Rules violations. Once a human review of reliable evidence establishes a violation in context, we terminate the account and subscription immediately, stop future renewals, and remove community access. We do not provide a warning or a second chance as a standard prerequisite. Prepaid fees are not refunded for that termination except to the extent a refund is required by applicable law, including rules against unfair or disproportionate forfeiture.
We cannot guarantee that all member content is reviewed before it appears. We may review reported or otherwise flagged content and remove or restrict material under the Community Rules, consistent with applicable law and our Privacy Notice. We may temporarily restrict access while investigating a credible safety, fraud, or security concern. An allegation alone is not proof. We provide the reason, applicable rule, effective action, and review route, unless disclosure is legally prohibited or must be limited to protect others. We apply these rules objectively and proportionately as required by law. The Community Rules describe how to challenge an incorrect decision. Review does not ordinarily restore access while pending.
11 Your data after termination
Termination does not cancel your applicable data rights. After a Community Rules termination, we automatically prepare a no-cost export of your eligible account and collection data and provide access through a private, authenticated download location independent of normal community access. We aim to make it available within 14 days and keep it available for at least 30 days after notifying you. We explain any necessary delay and comply with shorter statutory deadlines.
The export includes your collection records, your uploaded files where lawful, and other eligible user-provided content in commonly usable formats such as CSV, JSON, and original media. Messages and shared records are included only to the extent we can lawfully provide them without exposing other people’s protected information. We exclude passwords, security secrets, confidential reports, and material whose disclosure or possession is prohibited. We explain material omissions where lawful.
We verify identity without requiring a new paid subscription. Download links expire and are not publicly indexed; replacement access is available after verification during the availability period. Expiry of a link does not remove statutory access or portability rights. Our Privacy Notice explains deletion schedules and limited retention for billing, legal obligations, disputes, security, and backups. We do not promise immediate erasure of evidence we must lawfully preserve.
12 Service changes and availability
We use reasonable care and skill to provide the service and keep it secure. Maintenance, failures, and third-party outages may interrupt access; we do not promise uninterrupted availability. We notify you of significant planned disruption when reasonably practicable.
We may change the service to meet legal or security requirements, maintain compatibility, or improve functionality. Changes beyond those needed to maintain conformity will have a valid reason, impose no additional cost during an already paid term, and be explained clearly. For a materially adverse change, we provide advance notice in a form you can retain and applicable cancellation and refund rights. For EU consumers, legally required rights concerning more-than-minor adverse modifications apply, including the applicable 30-day termination window.
We give at least 30 days’ notice of price increases and apply them only to a future renewal, subject to longer notice and affirmative-consent requirements under applicable law. You may cancel before the new price applies.
13 Responsibility if something goes wrong
We are responsible for loss caused by our breach or failure to use legally required care, subject to applicable law. Nothing excludes liability for fraud, deliberate misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence, or any other liability or consumer remedy that cannot legally be excluded or limited.
For US consumers, only where enforceable, our total liability for ordinary contractual claims is limited to the greater of US $1,000 or the charges you paid us during the 12 months before the event giving rise to the claim. That limit does not apply to the exceptions above or nonwaivable privacy, data-protection, or statutory claims. Some states do not permit particular exclusions or limits; they apply only to the extent permitted in your state.
For EU consumers, the preceding US cap does not apply. You retain remedies for reasonably foreseeable loss and other remedies required by the law applicable to your contract. We do not require you to indemnify us for our own conduct or waive mandatory consumer protections.
14 Complaints and applicable law
Contact support@gatherthat.com with a complaint; we will acknowledge it and seek a fair resolution. You may also use any competent regulator, consumer authority, court, or dispute-resolution procedure available under applicable law. We identify any legally required alternative dispute-resolution body and whether we are obliged or willing to participate at [ADR INFORMATION URL OR CONTACT].
These Terms are governed by the law of [OPERATOR JURISDICTION], except that this choice cannot deprive you of mandatory protections in your country or state of habitual residence. EU consumers may bring proceedings in their competent home courts where applicable law provides that right. These Terms do not impose mandatory arbitration or a class-action waiver.
15 Changes to these Terms
We may update these Terms for changes in law, service features, or business operations. We publish the version and last-updated date and give at least 30 days’ advance notice of material changes, except where a shorter period is necessary for legal or urgent security reasons. We explain the reason and effective date. Changes do not retroactively change a dispute or a completed billing period.
Where fresh acceptance is required, we request it separately for the affected document. If you decline a material change, you may end the service and receive any refund required by law; we will not treat refusal alone as community misconduct. If a clause is unenforceable, the rest applies only to the extent the agreement can lawfully continue. You may retain a copy of these Terms and your acceptance record.
16 Electronic communications and newsletters
We normally send service notices, billing confirmations, policy updates, and account communications to your registered email address or through the service. Keep your email current. Where law requires a notice in a form you can retain, we provide that form; a changeable webpage alone is not a substitute. Any legally required consent to electronic records will be obtained separately, and mandatory rights to paper records or other delivery methods remain unaffected.
Marketing subscriptions are optional and separate from essential service notices. You may unsubscribe from marketing without ending your account. You may forward an unaltered newsletter to someone who may be interested, provided you respect their privacy, avoid bulk unsolicited distribution, and remove personal account or access links before forwarding. This permission does not authorize republication or sale of the newsletter.
17 Feedback and suggestions
You may send voluntary suggestions about improving GatherThat. Do not send confidential inventions, trade secrets, or proposals requiring confidentiality unless we first agree in writing. For nonconfidential product feedback you intentionally submit, you give us a nonexclusive, worldwide, royalty-free permission to use and adapt the suggestion to develop and improve our products without an obligation to compensate or credit you, unless we agree otherwise. That permission continues after account closure.
This provision covers product feedback only. It does not expand our license to your collection records, photographs, messages, or other ordinary account content, transfer ownership of your work, or override privacy rights or a separate written agreement. You must be entitled to provide the feedback and this permission.
18 Affiliate links and sponsored material
We may receive commissions when you buy through an affiliate link and may receive payment for sponsored placements or advertising. We identify material commercial relationships clearly alongside the relevant recommendation, link, or placement where required. This general statement does not replace a disclosure where you encounter that material. A paid placement does not guarantee an item’s authenticity, value, or suitability.
19 Legal restrictions on access
You must comply with applicable laws when using GatherThat, including applicable US export-control and sanctions rules. Do not use the service for a transaction or in a location where doing so is prohibited by applicable law. We may restrict access to comply with a legal obligation, with notice where lawful and preservation of any mandatory refund and data-access rights. This clause does not authorize restrictions unrelated to an applicable legal requirement.
20 Events beyond reasonable control
Neither party is responsible for a delay or failure to perform to the extent it is caused by an event beyond that party’s reasonable control that could not reasonably have been prevented or overcome. The affected party must take reasonable steps to limit the effects and resume performance, and we will inform you of a significant service interruption when reasonably practicable. This provision does not excuse security failures within our control, charges not otherwise due, or compliance with mandatory consumer remedies. If we cannot resume a paid service within a reasonable time, you may cancel and receive a refund for the unused period.
21 Transfer of the agreement
You may not transfer your account or contractual rights and obligations to another person without our written agreement, except where applicable law gives you that right. We may transfer this agreement as part of a merger, reorganization, or sale of the relevant business if the new provider assumes our obligations and the transfer does not reduce your contractual or mandatory rights. We will notify you and provide any cancellation or other remedy required by law. A transfer does not authorize personal-data use beyond applicable law and the Privacy Notice.
22 Other contract provisions
These Terms, the Community Rules, and the plan or transaction terms expressly presented and agreed before purchase form the agreement for the service. A separate agreement overrides a provision only where it clearly identifies the different term and you validly agree to it; mandatory protections always take priority. The Privacy Notice and Cookie Policy provide required information and do not replace separate consent where it is required. Nothing excludes rights arising from a misleading statement or a promise binding under applicable law.
A delay or failure by either party to enforce a right does not by itself waive that right. Any waiver applies only to the matter expressly covered. We may seek lawful remedies for an established breach, but these Terms impose no automatic duty on you to defend us or reimburse every claim, loss, or legal expense. Responsibility for a proven loss remains subject to applicable law and the safeguards in Section 13.
This version is written in English. We provide translations, notices, and support in other languages where required by law or expressly agreed. Mandatory local-language requirements and consumer-friendly interpretation rules prevail over any inconsistency. You can save a copy of the Terms and request a retainable copy of the version you accepted from support@gatherthat.com.
